PEI Compliance

PEI Food Safety Law: What You Need to Know

Food safety in Prince Edward Island is set by the PEI Food Premises Regulations (PEI Reg EC16/79) made under the Public Health Act (R.S.P.E.I. 1988, Cap. P-30.1).

The PEI Chief Public Health Office enforces food safety province-wide. PEI Environmental Health carries out the inspections. The Department of Health and Wellness issues all food premises licences.

Section 24 of the Food Premises Regulations is the training rule:

PEI Food Premises Regulations, Section 24 (PEI Reg EC16/79) "The licence holder must successfully complete a food hygiene training program. When the licence holder is absent from the food premises, at least one employee with valid food hygiene training certification must be present when food is being prepared or processed. Any person who comes into contact with food or food-contact surfaces must receive food safety training. Food handler certificates must be produced for public health officials during an inspection."

PEI is strict on posting. Your food handlers certificate PEI must be displayed in a location easily accessible to public health officials. Not in a drawer. Not in a desk file. Posted where an inspector can see it.

Inspections in PEI use four result categories. Satisfactory means you passed. Unsatisfactory means a follow-up inspection is required. Health Order means the Chief Public Health Officer issued a written order to fix a problem. Closure means an immediate shutdown to protect public health.

PEI inspectors visit before opening, then every 4 to 6 months. They can also show up after a complaint. Results are public on the PEI government website. Inspectors will ask to see your food handler certificate and your food safety plan.

PEI food premises licences are renewed every year on March 31. The Public Health Act sets serious penalties for breaking the rules. Fines can be issued for each day an offence continues. Inspectors can also order recalls, suspend your licence, or close your business.

Our PEI food safety course meets Section 24 of the Food Premises Regulations. It is also called food handler training PEI and food safety training PEI. The same food handlers certificate PEI works across the entire Island. Switch jobs or move communities and it still counts.

Why PEI restaurants need to post certificates and train every food handler

Samira Ali, Certified Public Health Inspector, 10+ years across Canada

"PEI has two rules that catch owners off guard. First, your certificate must be posted where an inspector can see it. Not filed away. Posted. Second, any person who touches food or food-contact surfaces needs food safety training. Not just the licence holder. Every prep cook, dishwasher, and busser. I see PEI Environmental Health inspectors issue Health Orders for these two issues all the time. Certify everyone who handles food. Post every certificate. That is how you avoid a Closure on your record."
