Nunavut Compliance

Nunavut Food Safety Law: What You Need to Know

Nunavut food safety is set by one law. The Nunavut Public Health Act. Nunavut is one of the only places in Canada without specific food rules.

The Nunavut Department of Health enforces the Act. Environmental Health Officers do the inspections.

The Public Health Act sets the food safety duty:

Nunavut Public Health Act "Food operators must ensure total food safety by always operating in a clean and sanitary manner, maintaining premises and vehicles under clean and sanitary conditions, taking reasonable measures to prevent food contamination, and taking reasonable measures to protect the public from food-related health hazards."

Here is the truth. Nunavut does not require every food business to hold a food handler certificate. The Act sets the general duty. It does not name a training program. Most Nunavut employers ask for certification anyway because it proves due diligence.

Inspectors can enter any place if they think an offence has happened. They can take samples, make recordings, and seize evidence. They can order food destroyed. They can shut down a business. They can issue fines.

Nunavut fines are some of the highest in Canada. Repeat offenders can be fined up to $100,000. Companies can be fined up to $1,000,000. Plus business closures.

One thing is unique to Nunavut. The territory has country food guidelines for schools and community programs. These cover safe handling of caribou, char, seal, and other country food. Our course teaches the general food safety rules that apply to all food.

Our Nunavut food safety course meets the duty under the Public Health Act. It is also called food handler training Nunavut and food safety training Nunavut. The same food handlers certificate Nunavut works across the whole territory.

Why Nunavut food businesses should certify despite the penalty risk

Samira Ali, Certified Public Health Inspector, 10+ years across Canada

"Nunavut is unique. There is no specific training mandate in the Public Health Act. But the penalties are some of the highest in Canada. Up to $100,000 for individuals on repeat offences. Up to $1 million for corporations. If you operate a food business in Iqaluit or anywhere else in Nunavut, you need to prove due diligence. Certification is the easiest way to do that. It shows the Environmental Health Officer you took reasonable measures. The Act is general. The penalties are not."
