New Brunswick Compliance

New Brunswick Food Safety Law: What You Need to Know

Food safety in New Brunswick is set by two main rules. The Public Health Act (SNB 1998, c P-22.4). And the Food Premises Regulation (NB Reg 2009-138) made under that Act.

The Food Premises Regulation sorts businesses into classes. Class 3 is storage and sale only, no processing. Class 4 is restaurants, cafes, food trucks, and any place that prepares food for retail. Class 5 is processing for wholesale.

The Class 4 rule is where the food handler certificate requirement lives:

NB Food Premises Regulation 2009-138, Class 4 rule (effective July 1, 2012) "A licensee who operates a Class 4 food premises must ensure that the manager of the food premises holds a valid Food Handler certificate and that there is at least one Certified Food Handler present in food preparation areas at all times that food is being prepared."

This means two things. First, your manager must hold a food handlers certificate New Brunswick. Second, at least one certified person must be in the kitchen any time food is being prepared. Not just on the floor. In the prep area.

NB Health Protection Services runs the inspections. Inspectors can enter your business at any time. They can check your certificate, take samples, issue fines, and close your business. Food premises licences expire March 31 every year and must be renewed.

Penalties under the Public Health Act are set by the Provincial Offences Procedure Act. Fines can be multiplied by the number of days the offence continues. Inspectors can also order recalls, vacate premises, and shut down operations.

Our New Brunswick food safety course meets the Class 4 rule under Section 39 of NB Reg 2009-138. It is also called food handler training New Brunswick and food safety training New Brunswick. The same food handlers certificate New Brunswick works across the entire province. Switch jobs or move cities and it still counts.

Why New Brunswick Class 4 businesses need backup certification

Samira Ali, Certified Public Health Inspector, 10+ years across Canada

"New Brunswick has a Class 4 rule that catches a lot of owners off guard. The manager must hold a certificate. Plus a certified person must be in the food prep area whenever food is being prepared. Not just on the floor. In the kitchen. I see the same gap on NB inspections. The manager is certified but is in the office during prep. Or the certified line cook is on break. The business gets penalized. If you run a Class 4 food premises, certify at least three people. The manager, one prep lead, and one backup."
