Hamilton Public Health Services inspects every food premise in the City of Hamilton under Ontario Regulation 493/17 (Food Premises), made under the Health Protection and Promotion Act. Hamilton has no separate bylaw for food handler training. The rule comes from Section 32 of the provincial regulation, and it applies to every food service premise: any place where meals or meal portions are prepared for immediate consumption, or sold or served ready to eat.
32. Every operator of a food service premise shall ensure that there is at least one food handler or supervisor on the premise who has completed food handler training during every hour in which the premise is operating.
The regulation defines food handler training as food safety training provided by a local board of health, or through a program the Ministry has recognized as equivalent to the Ministry's food safety training standards. This course meets that standard, so your certificate counts toward the Section 32 rule at every Hamilton food service premise. It is also accepted by every other public health unit in Ontario, so it stays valid if you change jobs or move to Burlington, Toronto, or anywhere else in the province. See the province-wide Ontario food handlers certificate page for the full picture.
Hamilton Public Health Services inspects food premises on a risk-based schedule and after complaints. Inspectors can ask to see the certificates of the food handlers on shift. If your certified person is off sick and nobody else is certified, you are short for that hour. The City of Hamilton publishes its food premises rules and inspection information on hamilton.ca.
